What happens when the car is not insured and you get into a car accident and the cars in your name?

Understand, in California, insurance is required on all vehicles operated or parked on roadways.  If you don't have insurance and get into an accident any or all of the following can happen:

  • Your license will be suspended for six months at a minimum. If you are lucky, the suspension will only be for six months, it's up to the court and they can make it even longer.
  • Your vehicle registration could be immediately suspended by the DMV.
  • Most likely you will be sued by the other driver even if you aren't at fault. The other driver's car will need to be fixed and if there is no insurance either that driver or the insurance company they use will sue you. The amount you are sued for will be much higher than the damage to the vehicle and any medical costs for injuries. You will also be expected to pay attorney and court fees as well.
  • When you decide to get insurance, your rates are going to be much higher than those for previously insured drivers. By not having insurance you violated the law and insurance companies always charge higher premiums for people who have vehicle code violations on their driving record.
  • If you are injured in the accident you won't receive any compensation for your suffering. You are completely on your own.
